Scope

This data protection declaration informs you about the processing of personal data by us, KUANTIC GmbH. 

This data protection declaration can be accessed on the website and printed out at any time.

We reserve the right to amend this data protection declaration in compliance with the statutory provisions.

Personal data ("data") are processed by us only as necessary and for the purpose of providing a functional and user-friendly website, including its content and the services offered there.

Processing" of data means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organisation, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction. 

The legal basis for data protection can be found in particular in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data, on the free movement of such data and repealing Directive 95/46/EC ("General Data Protection Regulation", DSGVO) as well as in the German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG).

Scope of data processing

We process data within the scope of our offer on this website or for the purposes of providing software and hardware also from third party providers. 

We process contact information, usage data or other information that you provide to us

We process your personal data for the following purposes:

  • Communication or storage/processing of data in order to establish, implement and/or handle a contractual relationship (also verbal) with you (legal basis: Art. 6 para. 1 p. 1 lit. b. DSGVO);
  • Compliance with legal obligations (e.g. commercial or tax retention obligations) (legal basis: Art. 6 para. 1 p. 1 lit. c. DSGVO); 
  • Compliance with legal obligations (e.g. commercial or tax retention obligations) (legal basis: Art. 6 para. 1 p. 1 lit. c. DSGVO); assertion, exercise and defence of legal claims (legal basis: Art. 6 para. 1 p. 1 lit. f. DSGVO), whereby our legitimate interest lies, for example, in the assertion of legal claims and defence in legal disputes; 
  • With your consent for the purposes stated when granting this (legal basis: Art. 6 para. 1 p. 1 lit. a. DSGVO or Art. 9 para. 2 p. 1 lit. a. DSGVO for special categories of personal data); or
  • As otherwise described in this Privacy Policy or to you.

You provide data to us if this is necessary for the stated purposes. Failure to provide data may result in legal disadvantages for you, such as loss of legal position, for example, no response to your request.

We, our affiliated companies such as Kuantic SAS based in France, or the third party service providers we use will generally process your personal data within the EU/EEA. As soon as your data is processed outside the EU/EEA, compliance with European data protection standards is ensured in each case and we will inform you of this. 

Furthermore, we have taken technical and organisational measures to ensure that the regulations on data protection are observed both by us and by external service providers.

Your rights

You have the following rights: 

  • the right to information, 
  • the right to rectification or deletion, 
  • the right to restrict processing, 
  • the right to data portability,
  • the right to revoke any consent you have given.
  • You also have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(1)(e) or (f) DSGVO; this also applies to profiling based on these provisions.

You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us (e.g. for Berlin at the Berlin Commissioner for Data Protection and Freedom of Information, Friedrichstr. 219, 10969 Berlin or online https://www.datenschutz-berlin.de/buergerinnen-und-buerger/ihre-beschwerde-bei-uns/).

Storage and deletion of data

As a rule, we only store your personal data for as long as it is necessary for the performance of the contract or the respective purpose and limit the storage period to an absolutely necessary minimum. 

We or the third-party providers used further delete the data in accordance with the following criteria: Time lapse and completion of a request, default settings of the third-party providers, etc. We also store your data if we are obliged to do so in accordance with statutory retention periods (e.g. in accordance with the German Commercial Code (HGB) or the German Fiscal Code (AO)). In order to preserve evidence, we may further store data within the framework of the statute of limitations, whereby these statute of limitations periods according to §§ 195 ff. of the German Civil Code (BGB) are generally three years and begin to run at the end of the year in which the claim arose. 

Contact, contact form and e-mails

If you write to us via the contact form on the website, send an e-mail or contact us in any other way, the information you provide in the respective enquiry, including the contact data you provide there, name and e-mail address or other data provided, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. This data is only processed on the basis of your consent (legal basis Art. 6 para. 1 p. 1 lit. a. DSGVO) or on the basis of a prospective or existing business relationship with us (legal basis Art. 6 para. 1 p. 1 lit. b. DSGVO). 

Newsletter 

With our newsletter we inform you about us and our offers. 

Only your e-mail address is required to register for the newsletter. If you register for the newsletter, your e-mail address will be transferred to us (or our mail provider) and stored there. After registration, you will receive an e-mail to confirm the registration ("double opt-in"). When you register for the newsletter, the following data is processed:

Contact data (e-mail address, name if applicable), device data  (device name, country code if applicable, language, name of operating system and version), connection data (IP address, mail provider).

This storage serves as proof in the event that a third party misuses an email address and registers to receive the newsletter without the knowledge of the authorised person. 

To send the emails, we use the service 'Mailchimp' from The Rocket Science Group LLC d/b/a Mailchimp, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, Georgia 30308, USA. Mailchimp processes the above data on our behalf on servers in the USA (see our agreement with Mailchimp on this: https://mailchimp.com/legal/data-processing-addendum/). To comply with the level of data protection applicable in the EU, the provider of Mailchimp is certified in accordance with the EU US Privacy Shield and has submitted to the EU Standard Contractual Clauses. We use the Mailchimp service to analyse the behaviour of newsletter recipients, such as whether they open the sent email or click on certain links in emails. When the newsletter is opened, the information contained (so-called web beacon) connects to Mailchimp's servers in the USA in order to analyse the user's behaviour. For this purpose, further technical information is collected, such as the IP address. This allows us to improve the quality of our newsletters, for example. The data processing for sending the newsletter is based on your consent (legal basis: Art. 6 para. 1 p. 1 lit. a. DSGVO). We further process your data based on our legitimate interest in marketing and product improvements (legal basis: Art. 6 para. 1 p. 1 lit. f. DSGVO).

REVOCATION / OPPOSITION: You can revoke your consent to the processing of data for the purpose of sending the newsletter at any time or object to the data processing. The revocation / objection can be made via a link contained in each newsletter or by sending a separate message to us. In doing so, you will not incur any costs other than the transmission costs according to the base rates.

Processing of access data when visiting the website 

We (or the web space provider) collect data about each visit to our website (so-called server log files). This data includes:

Name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, operating system, referrer URL (the previously visited page), IP address and the requesting provider.

as well as, if applicable, additionally when using a mobile device:

Country code, language, device name, name of the operating system and version.

We use this access data for statistical evaluations for the purpose of optimising our website as well as for data security reasons in order to ensure the stability and operational security of the website. If personal data (such as the IP address) is stored, this is done due to our legal obligations (legal basis: Art. 6 para. 1 p. 1 lit. c DSGVO) or due to our legitimate interest of fraud prevention and quality assurance (legal basis: Art. 6 para. 1 p.1 lit. f DSGVO).

Cookies

Our website sometimes uses so-called cookies. Cookies do not cause any damage to your end device and do not contain viruses. Cookies serve to make our offer more user-friendly, effective and secure. Cookies are small text files that are stored on your terminal device and saved by your browser.

There are different types of cookies that are used for different purposes. This website only uses so-called "technical" cookies. I.e. most of the cookies we use are so-called "session cookies". They are automatically deleted at the end of your visit. Session cookies are needed to assign successive page requests to the respective visitors of the website who access our website at the same time. Other cookies remain stored on your terminal device until you delete them. These cookies allow us to recognise your browser on your next visit.

OPPOSITION: You can also prevent the collection of data generated by the cookie and related to your use of the website (including IP address) to Google and the processing of this data by Google by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de. 

Insofar as personal data is processed when so-called "technical" cookies are used, this is based on the legal basis of Art. 6 para. 1 p. 1 lit. f. DSGVO due to legitimate interests of quality assurance and a technically flawless presentation of the website.

Google Analytics

We use Google Analytics on the website, a web analytics service provided by Google (a.o. Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland and Google LLC, Mountain View, CA, USA). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about the use of the website, such as 

browser type/version; operating system used; referrer URL (the previously visited page); host name of the accessing computer (IP address); time of the server request when using the website 

are generally transmitted to a Google server in the USA and stored there, although due to the activation of IP anonymisation on the website, the IP address is shortened beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. The full IP address is therefore not transmitted to a Google server in the USA and shortened there. IP anonymisation is active on the website. Google will use this information on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage. 

Insofar as IP anonymisation is omitted or personal data is processed, the data is processed on the legal basis of Art. 6 para. 1 p. 1 lit. f. DSGVO, whereby we pursue our legitimate interests (or the legitimate interests of third parties commissioned by us) of quality assurance or statistical analysis of user behaviour. If the use of cookies requires consent, the processing of the information or data is based on consent (Art. 6 para. 1 p. 1 lit. a DSGVO).

Google LLC is certified under the "Privacy Shield" agreement between the European Union and the USA and thus guarantees compliance with European data protection requirements (see: https://www.privacyshield.gov/). For users who are habitually resident in the European Economic Area or Switzerland, Google Ireland Limited is the controller of your data, unless otherwise stated in the privacy notice of a particular service. Google Ireland Limited is therefore the company associated with Google which is responsible for processing your data and complying with the applicable data protection laws.

Jetpack

We use Jetpack as a service provided by Aut O'Mattic A8C Ireland Ltd, Business Centre, No.1 Lower Mayor Street, International Financial Services Centre, Dublin 1, Ireland (or Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA). Jetpack uses, among other things, cookies (i.e. text files that are stored locally in the cache of your web browser on your terminal device), which enable an analysis of the use of our website. The user's IP address is processed in the process.

Data processing is based on our legitimate interests (or the legitimate interests of third parties commissioned by us) of quality assurance or statistical analysis of user behaviour (legal basis Art. 6 para. 1 p. 1 lit. f. DSGVO). If the use requires consent, the processing of the information or data is based on consent (Art. 6 para. 1 p. 1 lit. a DSGVO).

Automattic Inc. processes data in the USA, but is certified under the "Privacy Shield" agreement between the European Union and the USA and thus guarantees compliance with European data protection requirements (see: https://www.privacyshield.gov/).

Gravatar

With the service Gravatar (of the provider Aut O'Mattic A8C Ireland Ltd., Business Centre, No.1 Lower Mayor Street, International Financial Services Centre, Dublin 1, Ireland / Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA), profile pictures with email addresses can be stored and then displayed on other online presences in connection with posts or comments. For this purpose, the email address is transmitted to Gravatar in encrypted form. The use of Gravatar is based on our legitimate interests, as we offer the possibility to personalise comments or posts with a profile picture (Art. 6 para. 1 p. 1 lit. f DSGVO).

If you do not want a user image linked to your Gravatar email address to appear in the comments, you should use an email address that is not stored with Gravatar to comment.

When you visit one of our social media sites, data is processed both by us and by the above-mentioned providers as the responsible party. 

The respective social media provider assumes the data protection obligations towards you as a user, such as providing information on data processing and is the contact for your rights. This follows from the fact that the respective provider has direct access to the relevant information on the social media site and the processing of your data. However, you are also welcome to contact us if this should become necessary and we will then forward the request to the provider if necessary.

When using Twitter and LinkedIn, data may also be processed outside the EU. More information on this can be found in the privacy statements of LinkedIn and Twitter.

Our social media pages allow us to communicate with you and provide interesting information. In doing so, we may receive further data from you through your comments, shared images, messages and reactions, which we then process to respond or communicate with you. If you use the social media on several devices, a cross-device analysis of the data may take place. Furthermore, social media providers use cookies and tracking technologies to analyse and improve their services. Data processing is carried out with your consent or for the purpose of answering your enquiry (Art. 6 para. 1 p. 1 lit. a., b. DSGVO) or on the basis of legitimate interests in improving the offer, advertising and marketing activities and external presentation (Art. 6 para. 1 p. 1 lit. f. DSGVO). 

Data processing when using the software

We offer further services for business customers (entrepreneurs, § 14 BGB) in accordance with our General Terms and Conditions. Insofar as personal data is processed for these additional services, this is done in particular for the purpose of communication when initiating or executing the contract or as otherwise described in the General Terms and Conditions (legal basis: Art. 6 para. 1 p. 1 lit. b DSGVO), for the fulfilment of our legal obligations (legal basis: Art. 6 para. 1 p. 1 lit. c DSGVO) and on the basis of our legitimate interests (for example to improve our services or to defend against (legal) claims) (legal basis: Art. 6 para. 1 p. 1 lit. f DSGVO).
